Identification & Insurance
Customer agrees to provide a valid driver's license at the time of rental. Additionally, all trailer rentals require proof of insurance.
Care & Cleaning of Trailers & Equipment
All rentals are made with the understanding that normal wear and tear is included in the rental rate. However, any damage from misuse or improper care will be charged for. A $50 cleaning fee may be assessed by the Business to the Customer for any rented equipment that is returned in an uncleaned state.
Operating Condition
The Business agrees to perform an inspection with the Customer prior to delivery. In the event that the rented equipment is not operating as it should, the Customer agrees to contact the Business immediately.
Rental Days & Prices
Rentals are charged for time out, not time used. Overtime will be charged at the rate of $25 per overtime hour unless otherwise instructed.
No allowance will be made for any rented equipment or portion thereof which is claimed not to have been used. Acceptance of returned equipment by the Business does not constitute a waiver of any of the rights the Business has under the rental agreement.
Responsibility for Damage or Loss; Reporting to Police
Customer is responsible for all damage to, or loss or theft of, the rented equipment, including damage caused by weather, road conditions and acts of nature, whether or not you are at fault. Customer is responsible for the cost of repair or the actual retail cash value of the equipment if it is not repairable or if we deem it unrepairable. Customer is also responsible for Loss of Use, Diminished Value, missing equipment or parts, and a reasonable charge to cover administrative expenses connected with any damage claim. Customer must report all accidents involving a Trailer to the Business AND the Police within 4 hours of occurrence or discovery.
Tires – Road Damage - Flat Tires
Tire repairs are considered the responsibility of the Customer. In the event of a flat tire, the Customer can call a tire repair company of their choice or the Business can call a tire repair company on behalf of the Customer, at the sole expense of the Customer. The Business is not responsible for tire damage during the rental period. Please inspect tires prior to rental for good operating condition.
Pickup & Return
The Business will make the goods available for pick-up by the Customer at 15095 E County Road 500 N, Hope, IN 47246. Customer agrees to return the goods at the same location prior to the end of the rental period.
Recovery of Equipment
If the Customer is in default of any of the terms and conditions of this agreement, the Business, and its agents, at the Customer’s risk, cost and expense may at any time enter the Customer’s premises where the rented equipment is stored or used at all time and recover the rented equipment.
Location of Equipment
Customer shall inform the Business upon demand, of the exact location of the trailer at any time while it is in the Customer’s possession. The Business may use GPS tracking at any time to determine the location of the rented equipment.
Maintenance of Equipment
Customer shall keep and maintain the rented equipment during the terms of the rental period at customers own cost and expense. Customer shall keep the equipment in a good state of repair during the rental period.
Warranty
The Business makes no warranty of any kind regarding the rented equipment.
Hold Harmless
Customer indemnifies and holds the Business harmless for all injuries or damage of any kind for repossession and for all consequential and special damages for any claimed breach of warranty.
Attorney & Legal Fees
Customer shall pay all reasonable attorney and other fees, the expenses and costs incurred by the Business in protection its rights under this rental agreement and for any action taken by the Business to collect any amounts due the Business under this rental agreement.
Acceptance
These terms are accepted by the Customer upon delivery of the terms to the Customer or the agent or other representative of the Business.
